It feels great to help a client who has been harassed with hundreds of unwanted telephone calls get compensated, but I am writing this post to share a bit on what made it possible - good evidence.
The client followed the call and text documentation procedures I outline here and here, so I had great material to work with. I can't underscore enough how solid evidence greatly increases the settlement value of your lawsuit (settlement value is a direct reflection of your perceived chances and damages at trial).
My client had recordings of the voice calls, and the telemarketer had emailed a few times confirming their identity. My client had screenshots of the text messages, and some videos of clicking the links in the texts and showing it opening the telemarketer's website.
In the recordings my client didn't get aggressive and cause the telemarketer to hang up quickly, but my client didn't ask for more calls and politely expressed neutral or disinterest.
So good evidence, but nothing the ordinary person can't gather for their own case! No mad detective skills needed, just a little extra effort for each call and text that added up to a nice settlement in the end.
