Why does documentation add significant value to your telemarketing lawsuit?

Telemarketers often try to hide behind other companies

I consulted in a recent TCPA violations lawsuit and wanted to share with you why better documentation increases the value of your telemarketing violations litigation. In this lawsuit the plaintiff got a bunch of calls from someone identifying themselves as "ACME Corporation" (names changed to protect the guilty). But in calling the phone numbers back they were answered by an "Alpha Strategies".


The plaintiff used an investigation phone to call back and make an appointment with "Alpha Strategies". Lo and behold, "Alpha Strategies" was just taking messages for "ACME Corporation" and ACME was the kingpin the whole time.


Why does this matter?

The plaintiff suspected that when sued for illegal calls, ACME Corporation would deny being involved in the calls at all. A common telemarketer tactic is to claim that other people frequently make calls pretending to be "ACME Corporation, ACME Corporation doesn't make calls, they for sure didn't call the plaintiff, and they are prepared to swear to it. Telemarketers will do anything possible to muddy the water because the more uncertainly they can put in your case, the more likely you will be to walk away with a much smaller damages check (or nothing).


This defendant tried that tactic here, but because this plaintiff had documentation ACME was the kingpin behind Alpha, it added a zero to the value of his telemarketing lawsuit. Without that proof, the case would be much harder to proof and "harder to prove" lowers value of your case.
