How do we attack a creditor lawsuit?
How do we attack a creditor lawsuit?

If you retain NW Debt Resolution to defend you from a lawsuit, you should know what you are getting in return for your fee. First, we are going to show up in court so the creditor can't get a default judgement. Next we will conduct discovery to make the creditor prove their case.

We can't promise any particular outcome for your case but often creditors and collection agencies are sloppy, from lack of records to committing debt collection violations that open them up to a FDCPA countersuit.

While this is happening we will enquire if they would be amenable to a reduced settlement of the debt, or even walking away, in case they make an offer that is attractive to you.

Creditors and collection agencies rely on defendants not even showing up. They are almost never interested in a protracted legal battle against a determined defense attorney. Creditors and debt collectors are often suing hundreds to thousands of people every month and they do not have the resources if every defendant fights back.

So from filing an answer to their complaint, conducting discovery, defeating their summery judgement motion, filing our own summary judgement motion, it is very common the creditor or collection agencies loses interest or give up. In fact that is our business model. Most collection agencies in Washington already know who we are because we are willing to fight every step of the way.

They also know we work for a flat fee so our client can't run out of money, so they might as well throw in the towel early or resolve the debt for a favorable amount and go pick lower hanging fruit somewhere else. We want our reputation to cause them to give up early because they know we won't give up.

Would you like a free case review? Do you have a question or a telemarketing, debt collection, or bankruptcy case that would make a great blog article? We might even review your pro-se complaint or motion in a blog post. Email peter@nwdebtresolution.com and/or nathen@nwdebtresolution.com and we may answer it for everyone!

Are telemarketers harassing you in Washington, Oregon, or Montana? My Washington State TCPA plaintiff law practice can help, just give us a call at 206-800-6000 or email peter@nwdebtresolution.com.
