A do it yourself guide on filing an Answer in Washington State

Some of our clients are being sued for such small amounts it doesn't really make sense to hire an attorney. Paying as much or more than the lawsuit is asking for isn't sensible.


If you are being sued, you need to file an Answer to avoid being defaulted, and then a default judgment entered against you. Filing an Answer is fairly easy, and you can do it from the comfort of your home. We have a template you can download and adjust to fit your needs.

Look at the court documents you received, and change the template for your court, your state, your name, your case number, and the person suing you.

The court papers you received will have paragraphs alleging why the plaintiff should succeed and why you are in the wrong. You need to deny the allegations you don't agree with, or you don't have enough information to admit or deny.


Attorneys often deny them all.

Mail a copy of your Answer to the court listed in the papers you received, but also VERY IMPORTANT, mail and certify that you mailed a copy to the plaintiff's attorney as shown in the court papers.

It wasn't as hard as you thought, right? Sending an answer prevents the Plaintiff from getting a quick default judgement against you. In some cases you will never hear from the Plaintiff again, but we would recommend you check in with us (we often offer free phone advice) because this advice is not specific to you or your situation.
